🎉 COURT VICTORY: Septic Tank Restriction for STRs Struck Down as Unconstitutional

Today, we celebrate a critical victory for property rights and fairness. A Nevada District Court has ruled that Clark County’s short-term rental ordinance requiring STR homes to be connected to public sewer (among other things) is unconstitutional, violating the Equal Protection Clause of both the Nevada and United States Constitutions.
This decision affirms what we’ve said from the beginning: every homeowner deserves equal treatment, whether they are connected to sewer or septic. The County’s attempt to disqualify certain homes based solely on their infrastructure was not only unjust — it was illegal.
🛑 A Pattern of Government Overreach
While we expect Clark County to do what they’ve always done and appeal any ruling that favors private property owners, let’s be clear: they are wasting your tax dollars to defend unconstitutional ordinances.
This is part of a long-standing pattern where local governments use public money to fight their own residents, rather than fixing broken policies. But the courts are beginning to see through it — and we are winning.

The sewer connection requirement is no longer enforceable.
The court recognized this rule as an unjustified and discriminatory barrier designed to limit STR licensing.
This ruling strengthens the legal foundation for challenging other unconstitutional parts of the STR ordinance.
